TERMS AND CONDITIONS OF THE 925CRAFT WEBSITE

§ 1

GENERAL PROVISIONS

  1. These Terms and Conditions are the terms and conditions referred to in Article 8 of the Act on Provision of Electronic Services of 18th July 2002 (Journal of Laws No. 144, item 1204, as amended).
  2. These Terms and Conditions specify the rules for the use by Users of the 925CRAFT website, operating at 925craft.uk, which includes a wide range of products and types of services provided by SILVEXCRAFT Sp. z o.o. Sp. k. based in Tyczyn, aimed at potential business partners, including jewellers and handicraftsmen.
  3. The 925CRAFT website allows the User to be redirected by means of a provided link to the website operating at the following address: silvexcraft.eu, through which the User will be able to purchase products offered by SILVEXCRAFT Sp. z o.o. Sp.k.

§ 2

DEFINITIONS

  1. Data controller – SILVEXCRAFT Sp. z o.o. Sp. k. based in Tyczyn, 5 Orkana St., 36-020 Tyczyn, with numbers: Tax Number: 5170373027, Polish National Business Registry Number: 363361395, National Court Register: 0000588340.
  2. Cookies– small textual information created by the User’s web browser to support the operation of the software.
  3. 925CRAFT– website containing information on the product offer and services provided by SILVEXCRAFT Sp. z o.o. Sp. k. based in Tyczyn, Orkana 5, 36-020 Tyczyn, having the following numbers: Tax Number: 5170373027, Polish National Business Registry Number: 363361395, National Court Register: 0000588340.
  4. User – a legal person, an organisational unit that is not a legal person and to which the law grants legal capacity, a natural person that is not a consumer, within the meaning of the Civil Code, including a natural person, using the website operating at the address: 925craft.pl

§ 3

RULES OF USING THE 925CRAFT WEBSITE

The 925CRAFT website may be used by all Internet Users, provided that the ICT system of a given User meets the following minimum technical requirements: a) having access to the Internet service, b) having a working broadband Internet browser, and c) having an active e-mail account – in the case of the User’s wish to use the newsletter service referred to in § 5 of these Rules.

§ 4

PERSONAL DATA

  1. Personal data provided by the Users on the website 925craft.pl (in the contact form, in the form – we invite you to cooperate with us and in case of activation of the newsletter service), are processed by SILVEXCRAFT Sp. z o.o.. Sp. k. with its registered office in Tyczyn, 5 Orkana Street, 36-020 Tyczyn, having the following numbers: NIP: 5170373027, REGON: 363361395, KRS: 0000588340 (personal data controller).
  2. The provision of personal data by the User is voluntary, however, it is necessary in order for the User to use the newsletter service provided electronically and for 925CRAFT to respond to the questions asked by the User using the contact form in the ‘Contact’ section or the form – ‘We invite you to cooperate with us” – in the ‘Cooperation’ section. 925CRAFT processes personal data in order to provide services electronically in the event that the User gives the consent referred to in § 5.1 of these Terms and Conditions for the provision of the newsletter service and in the event that 925CRAFT replies to a question asked by the User via the contact form or the “We invite you to cooperate” form.
  3. The User has the right to access the content of his/her personal data and to correct and delete it. Personal data may be corrected or deleted by the Data Controller, who can be contacted at the following email address: [email protected]. By providing personal data, the User declares that the personal data provided by him/her is his/her data.

§ 5

NEWSLETTER

  1. The User may agree to order a newsletter service (subscription). The newsletter service consists of periodic sending of the 925CRAFT newsletter and messages containing marketing content (commercial information) of 925CRAFT and, if applicable, of its business partners (including content relating to the products of 925CRAFT and, if applicable, of its business partners and the Promotion) to the e-mail address provided. Subscription to the newsletter is made by providing your email address under the ‘Cooperation’ tab in the section marked ‘Newsletter’ and clicking on the ‘subscribe’ button.
  2. Newsletter subscription is voluntary and free of charge. The newsletter service is provided for an indefinite period of time and the User may unsubscribe from it at any time.
  3. The User may unsubscribe from the newsletter at any time independently by selecting the unsubscribe option in the newsletter message received.

§ 6

VALIDITY

If any provision of these Terms and Conditions is declared invalid by a final court decision, the remaining provisions shall remain in force.

§ 7

REPRESENTATIONS BY 925CRAFT

925CRAFT hereby declares that all images and content presented on the 925CRAFT website are copyrighted and belong to 925CRAFT.

§ 8

APPLICABLE LAW

The applicable law governing the services provided by 925CRAFT under the terms and conditions set out in these Terms and Conditions is Polish law. By accepting the content of these Terms and Conditions, the Parties hereby choose Polish law as the applicable law.

§ 9

FINAL PROVISIONS

  1. 925CRAFT uses information stored by the server on the User’s terminal equipment for statistical purposes and in order to provide the highest quality of services, which are then read each time the Internet browser is connected (so-called cookies). The User may, at any time, determine the conditions under which the 925CRAFT website stores or accesses cookies by means of the settings of his or her Internet browser, including changing the browser settings so that it does not accept such files or informs about their transmission. However, please note that not accepting cookies may result in difficulties in using the 925CRAFT website. By using a browser whose settings allow cookies to be stored on the User’s device, the User agrees to the storage of the aforementioned files on that User’s device.   2. 925CRAFT reserves the right to amend these Terms and Conditions for a valid reason, which is:
    • the need to adapt the Terms and Conditions to legislation directly affecting these Terms and Conditions and resulting in the need to modify the Terms and Conditions to comply with the law;
    • the need to adapt the Terms and Conditions to recommendations, orders, rulings, provisions, interpretations, guidelines or decisions of authorised public authorities;
    • expansion or change in the functionality of the 925CRAFT website, including the introduction of new services provided electronically or the change of existing functionalities of the 925CRAFT website;
    • A change in the technical conditions for the provision of electronic services;
    • the need to remove ambiguities, errors or clerical mistakes that may have occurred in the Terms and Conditions;
    • changes to contact details, names, identification numbers, electronic addresses or links provided in the Terms of Use;
    • To prevent abuse;
    • improvement of User service;
  3. The amended Terms and Conditions will be made available on the 925CRAFT website. 925CRAFT will inform you of the amended Terms and Conditions by sending a notification of the amended Terms and Conditions to the email address you provided when signing up for the newsletter.
  4. These Terms and Conditions are effective as of 29.03.2022.
  5. Any disputes which may arise from the functioning of the 925CRAFT website between the User and 925CRAFT and which cannot be prevented through the complaint procedure will be settled by the competent Polish common court.
  6. In matters not covered by these Terms and Conditions, the relevant provisions of the Civil Code and other applicable laws shall apply.
